CURRENTS OF WINDERMERE SWEEPSTAKES TERMS AND CONDITIONS

GENERAL
Harvard Developments Corporation (the “Sweepstakes Sponsor” or “Harvard”) is sponsoring the “$3,000 Back to School Shopping Spree” Sweepstakes (the “Sweepstakes”) which runs from 8:00 a.m. Wednesday, August 10, 2022, to 11:59 p.m. Monday, September 12, 2022 CST (the “Sweepstakes Period”). By entering this Sweepstakes, the entrant agrees to accept and abide by these rules and regulations (the “Sweepstakes Rules”). All decisions of the Sweepstakes Sponsor with respect to any aspect of this Sweepstakes, including without limitation of the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Sweepstakes.
ELIGIBILITY
The Sweepstakes is open to residents of Edmonton and area (+100 km) who are 18 years of age or older at the time of entry. The Sweepstakes is not open to owners or employees of Currents of Windermere retailers, and their immediate families or persons with whom the employee is domiciled.
HOW TO ENTER
To enter the Sweepstakes, entrants must completely fill out and submit the Online Entry Form found on https://shopcurrents.ca/backtoschool/. Limit of one (1) entry per person. In the case of multiple entries, only the first eligible entry will be considered, and the remainder will be void. No purchase is necessary to enter the Sweepstakes. Additionally, entrants who also upload a receipt from any Currents of Windermere retailer during the Sweepstakes Period will receive ten (10) bonus entries. By entering the Sweepstakes, each entrant consents to the use of their name, city/town of residence, phone number, and e-mail address for the purpose of conducting this Sweepstakes and, if consented, for marketing and promotional purposes.
PRIZE
The Sweepstakes will award one (1) Prize described as a Shopping Spree (“Prize”). The Prize holds an estimated retail value of $3,000. The Prize will consist of the following items:
● $100 Walmart gift card x10 (approximate, dependant on class size)
● $100 Winners/HomeSense gift card x10 (approximate, dependant on class size)
● $100 Staples gift card x10 (approximate, dependant on class size)
Prize must be accepted as awarded. Prize may not be sold, transferred and is not convertible to cash. The Sweepstakes Sponsor reserves the right to substitute the Prize in whole or in part in the event that all or any component of the Prize is unavailable. Prize winners are solely responsible for all costs not expressly described herein.
THE DRAW
Harvard Developments Corporation will make one random prize draw (“Draw”) to determine the Sweepstakes Winner (“Winner”). The Winner will be selected at 1:00 PM CST on Tuesday, September 13, 2022. The Winner will be notified by Phone and/or Email (as supplied during the Sweepstakes Entry) within approximately one business (1) day of the Draw (“Notification”).
The Prize will be awarded to the winner’s listed classroom and administered/rewarded in conjunction with Currents of Windermere and the classroom’s organizer (educator/principal) in accordance with the respective school’s policy. Each student of the winning classroom will receive one (1) $100 gift card of their choosing from one (1) of the retailers listed above (Walmart, Winners/HomeSense, Staples).
The Sweepstakes Sponsor assumes no responsibility for any inaccurate or incorrect information provided to it, or that results in any way from the transmission, receipt or processing of entries. If the first selected Winner does not respond within three (3) business days of first contact, the Sweepstakes Sponsor will have the right to disqualify that Winner and to randomly draw another eligible entry. By entering, you agree that if you are a selected Winner that is disqualified and a Prize is forfeited for any reasons, the Sweepstakes Sponsor will be fully and completely released and discharged from any liability or responsibility in this regard. Sweepstakes Sponsor is not responsible for the failure for any reason whatsoever of a selected Winner to receive Notification.
If selected Winner is not eligible or does not otherwise meet the requirements as set out in the Sweepstakes Rules, the Sweepstakes Sponsor will have the right to disqualify said Winner and randomly draw another eligible entry for purposes of awarding a Prize, and the Sweepstakes Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.
GENERAL CONDITIONS
All Sweepstakes entries must be received during the Sweepstakes Period. Harvard Developments Corporation accepts no responsibility and will not be liable for entries that are not received, are incomplete, lost, late, misdirected or illegible for whatever reason, including without limitation, due to computer or network or other system interruption, malfunction, failure or breakdown of any kind or duration. Harvard reserves the right in its absolute discretion, without any liability to any entrant to the Sweepstakes, to withdraw or modify the Sweepstakes should any of Harvard systems or its network be adversely affected by any virus or other similar destructive agent during the Sweepstakes Period. Participants may submit as many entries as they like. Duplicated entries will be counted as one entry.
The Sweepstakes is subject to all applicable federal, provincial, and municipal laws. Harvard shall be the sole judge and decision-maker regarding any dispute regarding the application or interpretation of the Sweepstakes Rules or any other aspect of the Sweepstakes and Harvard’s judgment or decision shall be final. Harvard retains the right in its sole and absolute discretion to suspend or change for any reason, the start and/or end dates of the Sweepstakes, or to modify, suspend or cancel the Sweepstakes in part or as a whole for any reason. Harvard reserves the right at its sole discretion to disqualify any individual from the Sweepstakes and to ban that individual from any future Harvard Sweepstakes whom it finds or believes to be tampering with the Sweepstakes entry process, the operation of the Sweepstakes or is acting in violation of the Sweepstakes Rules. Harvard Developments Corporation is the sole sponsor of this Sweepstakes. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram or any of our retailers.
PRIZE TERMS
By entering the Sweepstakes, entrants and selected entrants agree to release and hold harmless the Sweepstakes Sponsor and their directors, employees, officers, agents and affiliates from any injury, loss or damage of any kind to persons or property, including but not limited to death, resulting in whole or in part directly or indirectly from the acceptance, receipt, possession, use or misuse of an awarded Prize, participation in any Sweepstakes-related activity including any travel related thereto and/or participation in the Sweepstakes.
By entering the Sweepstakes, each selected entrant agrees to sign and return the following to Harvard within three (3) days of Notification:
A form affirming eligibility and compliance with all Sweepstakes Rules (form may require notarisation);
A liability release form releasing the Sweepstakes Sponsor, their directors, employees, officers, agents and affiliates from all liability arising from or relating to the acceptance, receipt, possession, use or misuse of an awarded Prize, participation in any Sweepstakes-related activity including any travel related thereto and/or participation in this Sweepstakes;
and A publicity release and consent form permitting the Sweepstakes Sponsor to use his or her name, city/town of residence and social media profile photo without compensation in publicity or advertising carried out in any medium worldwide by the Sweepstakes Sponsor and/or its advertising or promotional agencies without limitation or further notification unless permitted by law.
If the selected entrant fails to submit the above within the given time period, the Sweepstakes Sponsor reserve the right to disqualify said entrant and randomly draw another eligible entry for the purpose of awarding a Prize (time permitting), and the Sweepstakes Sponsor shall both be fully and completely released and discharged from any liability or responsibility in this regard; and,
Any other release/document as requested by the Sweepstakes Sponsor. The Sweepstakes Sponsor reserves the right, in their sole discretion, to terminate, modify or suspend the Sweepstakes, or modify the Sweepstakes Rules at any time for any reason whatsoever.
The Sweepstakes Sponsor will not be liable for any human or technical errors that may arise or occur in connection with the Sweepstakes. The Sweepstakes Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of the entries.
No correspondence will be entered into except with entrants requesting the Sweepstakes Rules by mail or requesting names of the Prize winners (for which a self-addressed, postage paid envelope must be included).
The Sweepstakes Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sweepstakes Sponsor as a result of technical problems or human error, or any combination thereof.
The Sweepstakes Sponsor reserves the right at their sole discretion to disqualify any individual who tampers with or attempts to tamper with the entry process.
ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SWEEPSTAKES SPONSOR RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION.
This Sweepstakes is governed by the laws of Alberta and the laws of Canada applicable therein, and is subject to all applicable federal, provincial and municipal laws and regulations.
By entering this Sweepstakes, the entrant agrees that the courts of the Province of Alberta, Canada shall have jurisdiction to entertain any action or other legal proceedings based on any provision of the Sweepstakes Rules or the running of this Sweepstakes. The entrant hereby irrevocably adheres to the exclusive jurisdiction of the courts of the Province of Alberta.
THE SWEEPSTAKES SPONSOR IS COLLECTING PERSONAL INFORMATION ABOUT ENTRANTS FOR THE SOLE PURPOSE OF ADMINISTERING THIS SWEEPSTAKES UNLESS OTHERWISE PROVIDED FOR BY THE SWEEPSTAKES RULES.
Sweepstakes Sponsor will not sell or transmit this information to third parties except for the purposes of administering this Sweepstakes. Any inquiry concerning personal information held by the Sweepstakes Sponsor should be forwarded to Harvard at (306) 777-0600.
